When to involve WorkCover WA in a compensation claim.
Australian employers are legally required to carry workers’ compensation insurance. WorkCover WA is the Government authority overseeing the workers’ compensation scheme. However, you will likely deal with your employer’s insurer when submitting a workers’ compensation claim. In our experience, insurers can and do challenge claims. This can obstruct or delay compensation payments, adding financial stress to a difficult situation.
The most common disputes arising between injured workers and the employer’s insurer are:
Pended or disputed claims
Low compensation payments
Unpaid treatment expenses
Insurer declines to fund treatment
Notification of a weekly payment reduction
Unsatisfactory return-to-work program

WorkCover claims: What you need to know
The first 14 days
Your employer has five days to lodge a completed workers’ compensation claim form with their insurer. The insurer must notify you of a decision within 14 days.
Pended claims
Your insurer can suspend their initial decision. They then have 10 days to make a decision. After 10 days, the decision is deemed to be in dispute.
What is an injury?
WorkCover WA treats physical and psychological injury the same. You are entitled to compensation if you develop an illness or suffer an injury at work.
No-fault scheme
Injured workers are not required to prove that their employer was responsible. However, insurers may dispute or pend a claim if the circumstances are unclear.
Common law claims
If you believe negligence contributed to your injuries, you may pursue a common law claim by suing your employer outside the WorkCover scheme.
Your entitlements
We work with clients whose lost income payments and treatment reimbursements were obstructed, unfairly reduced, or refused by insurers.
Settling a WorkCover claim
Keep in mind that settling a claim means you are not entitled to compensation in the future, which can cause financial stress for ongoing treatment or inability to work.
